TintenAI Consumer Terms of Use

1. Introduction

These Consumer Terms of Use ("Terms") are a binding agreement for all individual users ("you", "user") using the TintenAI platform. By accessing TintenAI, searching on the platform, or using any of our services, you declare that you have read, understood, and agree to comply with these Terms. If you do not accept these Terms, please do not use the platform.

• 1.1. Scope: These Terms cover all services provided through TintenAI's website (www.tinten.ai), mobile applications, and other digital channels.
• 1.2. Age Limit: You must be at least 18 years old or have the permission of a legal guardian to use the platform.

2. Service Description

TintenAI is an AI-powered smart search platform that allows users to discover products and services using natural language search. The platform connects users with products and services offered by various sellers but does not directly conduct sales, shipping, or service provision.

• 2.1. Purpose: TintenAI enables users to quickly find products and services that meet their needs and connect with sellers. For example, when a user searches for 'the most affordable laptop', TintenAI lists offers and products from different sellers.
• 2.2. Types of Services: The platform offers: Product and service search, Seller referral, Quote request processes, Personalized recommendations (AI-powered).
• 2.3. Limitations: TintenAI is only an intermediary platform and does not have direct control over product quality, delivery times, or service performance of sellers.

3. Terms of Use

You must comply with the following rules when using the platform:

• 3.1. Permitted Use: The platform may only be used for personal and non-commercial purposes. For example, it can be used for individual shopping or service research, but it is prohibited to resell or distribute platform data for commercial purposes. Users may only use the platform for lawful purposes.
• 3.2. Prohibited Uses: The following activities are strictly prohibited: Making misleading, fake, or fraudulent searches/queries. Using bots, automated software, or malicious code that may harm the platform infrastructure. Engaging in behaviors that violate the rights of other users or sellers.
• 3.3. User Responsibility: The user is solely responsible for all transactions (orders, payments, deliveries, returns, etc.) conducted with sellers reached through TintenAI. TintenAI cannot be held responsible for the outcomes of these transactions.

4. Sellers and Third Parties

TintenAI does not guarantee the accuracy, timeliness, or quality of the content provided by sellers listed on the platform. Users should be cautious in their dealings with sellers.

• 4.1. Intermediary Role: TintenAI is only a connection point between the user and the seller. All responsibility for products, services, or offers provided by sellers belongs to the sellers.
• 4.2. Seller Selection: Users should select sellers referred by TintenAI based on their own evaluations. TintenAI makes no commitment regarding the reliability or performance of sellers.
• 4.3. Disputes: In case of disputes between the user and the seller (e.g., incorrect product delivery or payment issues), TintenAI is not a direct party. However, users may contact our support team for assistance.

5. Prices and Offers

TintenAI does not control the prices and offers displayed on the platform; this information is provided by sellers.

• 5.1. Price Accuracy: Displayed prices may change instantly and depend on seller policies. TintenAI is not responsible for price errors or incorrect information.
• 5.2. Quote Request Process: For some products or services, a 'Get a Quote' option is offered. In this case: The user provides the necessary information (e.g., contact details) to request a quote. TintenAI forwards this information to the relevant seller. The seller contacts the user directly, and the quote process proceeds between the seller and the user.
• 5.3. Commission and Referral: TintenAI may receive commissions from sellers for some referrals or quote requests. However, this does not create any additional cost for the user.
• 5.4. No Order Placement: TintenAI does not place orders or process payments on behalf of the user.

6. Protection of Personal Data

TintenAI is committed to protecting users' personal data in accordance with the Law on the Protection of Personal Data No. 6698 (KVKK) and the General Data Protection Regulation (GDPR).

• 6.1. Data Collection: Data collected while using the platform (e.g., name, email, search history) is used only for service provision and to improve user experience.
• 6.2. Data Sharing: User information is shared with sellers only when necessary for services like 'Get a Quote' and with the user's consent.

• 6.4. Data Security: TintenAI applies industry-standard security measures to protect user data but cannot guarantee complete security of data transmitted over the internet.

7. Intellectual Property Rights

All content, software, algorithms, images, logos, and brands on the TintenAI platform belong to TintenAI or its licensors.

• 7.1. Permission to Use: Users may only access the platform for personal use and may not copy, distribute, or modify content without permission.
• 7.2. Violation: Users who violate intellectual property rights may face legal action and have their access to the platform restricted.

8. Account Security and User Obligations

Users are responsible for using their TintenAI account securely.

• 8.1. Information Accuracy: All information provided when registering or using the platform (e.g., email, phone number) must be accurate and up to date.

11. Governing Law and Jurisdiction

These Terms are subject to the laws of the Republic of Turkey.

• 11.1. Competent Court: In case of any dispute, Istanbul (Anatolian) Courts and Enforcement Offices have jurisdiction.
